Employment Practices Defense

Employment Practices Litigation Defense

Defense of California employers against claims by current and former employees, and practical advice to reduce the risk of those claims.

Claims the firm defends

  • Wrongful termination, including termination in violation of public policy
  • Discrimination based on protected characteristics under the California Fair Employment and Housing Act (FEHA)
  • Harassment, including sexual harassment
  • Retaliation, including whistleblower claims under Labor Code section 1102.5
  • Failure to accommodate and failure to engage in the interactive process for disability and other protected needs
  • Leave claims under the California Family Rights Act

How FEHA claims proceed

An employee generally must file a complaint with the California Civil Rights Department (CRD) before suing under FEHA and obtain a right-to-sue notice. The employer may first learn of a claim through a CRD complaint, a demand letter, or a lawsuit. Many claims are resolved through early mediation; others proceed in court or arbitration.

Insurance

Employment practices liability insurance (EPLI) may cover defense costs for some claims. Tender promptly and review the policy's consent and counsel provisions.

Prevention

  • Handbook and policy review
  • Investigation of internal complaints
  • Documentation of performance and discipline
  • Termination and separation agreements
  • Harassment prevention training compliance (required for California employers with five or more employees)
