Claims the firm defends
- Premises liability: slip-and-fall and other claims alleging a dangerous condition on business property
- General negligence: claims arising from business operations, vehicles, or employees' conduct
- Product claims: claims alleging a defective product, inadequate warnings, or breach of warranty
- Service claims: claims alleging negligent or deficient services, often alongside breach of contract
Working with insurers
Many liability claims are covered, at least in part, by commercial general liability or other policies. The firm can help tender the claim, review coverage positions and reservation of rights letters, and work alongside insurer-appointed defense counsel or as counsel for uninsured exposure. Where an insurer defends under a reservation of rights that creates a conflict, California Civil Code section 2860 may entitle the insured to independent counsel.
Contract risk transfer
Indemnity clauses, additional-insured endorsements, and vendor contracts may shift a claim to a contractor, landlord, or supplier. Those tenders should be made early.
Deadlines
Responses to a complaint are generally due 30 days after service. Preserve video, incident reports, maintenance logs, and product information as soon as a claim is reported.
